Step 1: search for a crazy and cool brand name
Search for a brand name which is suitable for your business, it should be relatable so that the brand can bring traffic for you. Don’t think of using a simpler one because those are already taken by the people who are in the business for a long time. Go for a crazy and cool name that is, of course, a unique one. Do a little research and find out if the name you are going to use is not being used by someone already.
Step 2: Go and Make the trademark application
As soon as you are done with your brand name your next step is to fill the trademark application form. The one-time fee to fill the application form is INR 3500 plus you need to attach the following document with the form.
• The identity proof of the directors of the company or business you want to register should be attached with the form.
• A standard sized- 9×5 cm photo of your brand logo will be also be required.
• If you are using the brand in some other country, claim proof will also be needed to be attached to the form.
Step 3: complete the form filling procedure
There are mainly two ways to fill the trademark registration form: e-filling or manual filling. For the process of manual filling, you will need to fill the application form and submit it to the office of trademark registration in Ahmedabad, Mumbai, Kolkata, Chennai, and Delhi. You will then receive your receipt of acknowledgment of application form within 15-20 days. In case you go for extolling you will get the acknowledgment receipt immediately after completing the application process.
Step 4: Examination of brand name
Here is the advantage of using a quirky brand name. After the submission of your application, the registrar will check the brand name to avoid any kind if disputes and arguments afterward. He will check if the brand name is according to the law and doesn’t match any registered or pending brand names.
Step 5: Publication of trademark in trademark generals
Your trademark will be published in Indian trademark generals after passing from the registrar. It will open for any opposition for 90 days which can be expanded to 120 days in some cases.
Step 6: Trademark registration certificate
After the completion of 90 days period, if no disputes arise at the time, your trademark will be registered under the seal of trademark registry and they will issue the certificate of trademark registration.
